Refund & Cancellation Policy
This policy sets out when refunds are issued for services purchased from Horacek Marketing and explains your statutory cancellation rights under German and UK law.
1. Right of Withdrawal (Consumers in the EU & UK)
If you are a consumer you have the right to withdraw from a distance contract within 14 days of its conclusion without giving any reason (§§ 312g, 355 BGB / regulation 29 of the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013). To exercise the right, send a clear statement (e.g. by email to contact@horacek.online). On valid withdrawal we will refund any payment received without undue delay and at the latest within 14 days using the same payment method.
The right of withdrawal expires early if you expressly request that we begin performance during the 14-day period and acknowledge that you lose the right once the service has been fully performed (§ 356(4) BGB / reg. 36 UK CCRs). For services partially performed during the withdrawal period at your request, you owe a proportionate amount for work actually carried out.
2. Monthly Retainers (Business Clients)
Retainers are billed monthly in advance for ongoing work. Outside the consumer withdrawal scenario above, fees for a started billing period are non-refundable because resources, tooling and ad-account work are allocated at the start of the period.
3. Cancellation of Renewal
You may cancel future renewals at any time with 14 days' written notice to contact@horacek.online. Services continue until the end of the already-paid period.
4. Defective or Non-Conforming Services
Where services are not delivered with reasonable skill and care, you are entitled to remedies under § 634 BGB or, for UK consumers, sections 54–56 of the Consumer Rights Act 2015 (repeat performance, price reduction or, where appropriate, a refund). Please notify us within 14 days of becoming aware of the issue at contact@horacek.online so we can investigate and remedy the defect.
5. Third-Party Costs
Advertising spend, platform fees and any third-party software or tools are charged directly to your accounts by those providers and cannot be refunded by us.
6. Chargebacks
Please contact us before initiating a chargeback. We aim to resolve any payment issue amicably and quickly.
